Actual colors and appearance may vary depending on your device, display settings, printing processes, materials, and normal production tolerances.
We reserve the right to modify or discontinue products, services, features, or pricing at any time, subject to any obligations relating to orders already accepted.
Product availability may be limited and is not guaranteed until an order is accepted and processed.
3. Orders and Acceptance
Submitting an order through the website constitutes an offer to purchase the products identified in the order.
We reserve the right to accept, reject, limit, or cancel an order for legitimate business reasons, including product availability, pricing or listing errors, suspected fraud, payment issues, shipping limitations, or inability to fulfill the order.
If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.
An automated order confirmation does not necessarily constitute final acceptance of an order.

5. Customized and Corporate Edition Orders
Customized and Corporate Edition products may include customer-provided logos, names, artwork, messages, colors, or other content.
Where a proof is provided, you are responsible for reviewing the proof carefully before approval, including spelling, logos, layout, colors, dates, and other customized content.
Once you approve the final proof and production begins, customized products generally cannot be cancelled, returned, or refunded except as stated in our Return and Refund Policy or as otherwise required by law.
By providing logos, artwork, photographs, trademarks, text, or other materials for use in a customized product, you represent that you own those materials or have sufficient authorization to provide and use them for the requested purpose.
You grant Proform Safety a limited, non-exclusive license to reproduce and use those materials solely as reasonably necessary to prepare, manufacture, fulfill, and deliver your customized order.
You retain ownership of your customer-provided materials.
6. Intellectual Property
Unless otherwise indicated, the website and its contents—including text, safety content, calendar content, graphics, artwork, designs, photographs, logos, page layouts, downloadable materials, and other original content—are owned by or licensed to Proform Safety and are protected by applicable intellectual-property laws.
Your purchase of a product does not transfer ownership of any underlying intellectual property.
You may use purchased products for their intended personal, workplace, educational, or internal business purposes.
Except as permitted by law or with our prior written authorization, you may not reproduce, republish, distribute, sell, license, create derivative commercial works from, systematically extract, or otherwise commercially exploit our protected content.
Company names, trademarks, logos, or other materials provided by customers for customized orders remain the property of their respective owners.

Daily Safety Calendar products and website content are intended to provide general safety awareness and educational information.

To the extent permitted by applicable law, you agree to indemnify and hold Proform Safety, LLC harmless from third-party claims, damages, liabilities, and reasonable costs arising from:

- customer-provided content that infringes a third party's intellectual-property or other legal rights.
This provision does not require a consumer to indemnify us for our own negligence, misconduct, or violation of law.

For Corporate Edition orders supported by a separate written quotation, proposal, purchase order, or agreement accepted by Proform Safety, the terms of that written transaction document will control to the extent they expressly conflict with these website Terms.
